1. Agreement to Terms
By accessing or using Raintell ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service.
These terms apply to all clients, account holders, and anyone who accesses the Raintell platform or receives services from us.
2. Description of Service
Raintell provides private operational visit services for independent hospitality venues. Our service includes:
- Anonymous guest visits conducted by trained evaluators
- Structured observation and scoring across defined categories
- Private written reports delivered to your dashboard
- Historical trend tracking and score comparisons
- Custom owner questions answered on every visit
We do not guarantee specific outcomes, improvements in scores, or business performance as a result of our service.
3. Account Access
Your account is personal and non-transferable. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us immediately if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your credentials.
4. Fees and Payment
Our service requires a one-time setup fee and a monthly subscription fee, as published on our pricing page. Fees are subject to change with reasonable notice.
- The setup fee is due before your first visit and is non-refundable once onboarding has begun.
- Monthly subscription fees are billed in advance. Failure to pay may result in suspension of your account.
- All fees are stated in US dollars.
5. Cancellation
You may cancel your subscription at any time by contacting us at support@raintell.com. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial months.
We reserve the right to cancel or suspend your account if you violate these terms, fail to pay fees, or use the service in a manner that is harmful or disruptive.
6. Confidentiality and Report Ownership
All visit reports are confidential and belong to you, the client. We will not share your reports with third parties, other clients, or your staff.
We may use aggregated, anonymized data for internal service improvement purposes. No identifying information about your business will ever be disclosed.
You agree not to publicly publish or distribute your visit reports in a manner that misrepresents our service or the context of the findings.
7. Evaluator Conduct and Anonymity
Our evaluators visit your venue as anonymous guests. You agree not to attempt to identify, expose, or retaliate against any evaluator for conducting a visit on your behalf.
Evaluator names and identifying information are never disclosed in reports and are considered confidential.
8. Prohibited Use
You may not use our service to:
- Harass, surveil, or retaliate against employees based on visit findings
- Misrepresent our reports to employees, partners, or the public
- Attempt to identify, contact, or interfere with our evaluators
- Resell or share your account access with third parties
- Violate any applicable law or regulation
9. Limitation of Liability
To the fullest extent permitted by law, Raintell's total liability to you for any claims arising from these terms or our service shall not exceed the total fees paid by you in the three months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption, even if we have been advised of the possibility of such damages.
Our service provides observational data and is not a substitute for professional legal, health, safety, or compliance advice.
10. Disclaimer of Warranties
Our service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of inaccuracies.
11. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by email or by posting a notice in your dashboard. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of the United States. Any disputes arising from these terms or our service shall be resolved through binding arbitration or in a court of competent jurisdiction.
